In this article, we develop and defend a new argument for animalism -- the thesis that we human persons are human animals. The argument takes this rough form: since our pets are animals, we are too. We’ll begin with remarks on animalism and its rivals, develop our main argument, and then defend it against a few replies.

I introduce and argue for a Priority Principle, according to which we exemplify certain of our mental properties in the primary or non-derivative sense. I then apply this principle to several debates in the metaphysics and philosophy of mind.

Greek New Comedy, as we know it from references and fragmentary MSS., is the meeting-place of three confluent streams—comedy of manners, Aristophanic comedy, and tragedy. From Sicilian comedy, through Epicharmus at Syracuse and Crates and Pherecrates at Athens, it inherited certain stock stage figures, and a tradition of ‘invented’ plots and sententious speech. Old Comedy it resembled in its fun and informality and many stage conventions; and, indeed, the resemblance was so marked, in at least one of the later plays (...) of Aristophanes, that the writer of his life, mistaking effect for cause, claimed the lost Cocalus as the original model of New Comedy. Perhaps most important of all was the influence of tragedy; and this influence may be estimated by a direct comparison between Euripides and Menander, both in the spirit and form of their plays and in the social and philosophic theories underlying them. Here is a question as intriguing as it is brief: what are we? The animalist’s answer is equal in brevity: we are animals. This stark formulation of the animalist slogan distances it from nearby claims—that we are essentially animals, for example, or that we have purely biological criteria of identity over time. Is the animalist slogan—unburdened by modal or criterial commitments—still interesting, though? Or has it lost its bite? In this paper, I will examine John Smeaton’s contribution to the vis viva controversy in Britain, focusing on how the hybridization of science, technology, and industry helped to establish vis viva, or mechanic power, as a measure of motive force. Smeaton, embodying the ‘hybrid expert’ who combined theoretical knowledge and practical knowhow, demonstrated that the notion of vis viva possessed a greater explanatory power than momentum, because it could be used to explain the difference in efficiency between overshot and undershot (...) waterwheels. Smeaton’s conclusions were correct since waterwheel efficiency was already measured in terms that were proportional to vis viva, not momentum, as a result of the industrial applications of waterwheel technology, which favored measuring efficiency by the product of mass and vertical displacement. Toward the end of the eighteenth century, the loss of motive force in the inelastic collision driving the undershot wheel began to be seen as equivalent to the expenditure of labor in the manufacture of commodities, further underlining how strictly scientific conclusions about motive force could have their origin in industrial practices. Here's an interesting question: what are we? David Barnett has claimed that reflection on consciousness suggests an answer: we are simple. Barnett argues that the mereological simplicity of conscious beings best explains the Datum: that no pair of persons can itself be conscious. In this paper, I offer two alternative explanations of the Datum. If either is correct, Barnett's argument fails. First, there aren't any such things as pairs of persons. Second, consciousness is maximal; no conscious thing is a proper (...) part of another conscious thing. I conclude by showing how both moves comport with materialist theories of what we are and then apply them to another anti-materialist argument. (shrink)

In thinking about ontology as the study of being or what fundamentally exists, we can adopt an ontology that either takes substances or processes as primary. There are, however, both commonsense and naturalistic reasons for not fully adopting a substance ontology, which indicate that we ought to suspend judgment with respect to the acceptance of a substance ontology. Doing so allows room to further explore other ontologies. In this book, Andrew M. Winters argues that there are both commonsense and (...) naturalistic reasons for further pursuing a process ontology. Adopting a process ontology allows us to overcome many of the difficulties facing a substance ontology while also accommodating many of the phenomenon that substance ontologies were appealed to for explanation. Given these reasons, we have both commonsense and naturalistic reasons for pursuing and developing a metaphysics without substance. (shrink)

Some strange cases have gripped philosophers of mind. They have been deployed against materialism about human persons, functionalism about mentality, the possibility of artificial intelligence, and more. In this paper, I cry “foul”. It’s not hard to think that there’s something wrong with the cases. But what? My proposal: their proponents ignore questions about composition. And ignoring composition is a mistake. Indeed, materialists about human persons, functionalists about mentality, and believers in the possibility of artificial intelligence can plausibly deploy moderate (...) theories of composition in defense of their views. And as it turns out, these strange cases are an interesting source of evidence for moderate theories of composition. (shrink)

Making room for agency in a physical world is no easy task. Can it be done at all? In this article, I consider and reject an argument in the negative.

Systematic study of the intersection of ethics consultation services and solid organ transplants and recipients can identify and illustrate ethical issues that arise in the clinical care of these patients, including challenges beyond resource allocation. This was a single-centre, retrospective cohort study of all adult ethics consultations between January 1, 2007, and December 31, 2017, at a large academic medical centre in the north-eastern United States. Of the 880 ethics consultations, sixty (6.8 per cent ) involved solid organ transplant, thirty-nine (...) (65.0 per cent) for candidates and twenty-one (35.0 per cent ) for recipients. Ethics consultations were requested for 4.3 per cent of heart, 4.9 per cent of lung, 0.3 per cent of liver, and 0.3 per cent of kidney transplant recipients over the study period. Nurses were more likely to request ethics consultations for recipients than physicians (80.0 per cent vs 20.0 per cent, p = 0.006). The most common reason for consultation among transplant candidates was discussion about intensity of treatment or goals of care after the patient was not or was no longer a transplant candidate. The most common reason for ethics consultation among transplant recipients was disagreement between transplant providers and patients/families/non-transplant healthcare professionals over the appropriate intensity of treatment for recipients. Very few consultations involved questions about appropriate resource allocation. Ethics consultants involved in these cases most often navigated communication challenges between transplant and non-transplant healthcare professionals and patients and families. (shrink)

Science and religious faith are two of the most important and influential forces in human life, yet there is widespread confusion about how, or indeed whether, they link together. This book describes this combination from the perspective of one who finds that they link together productively and creatively.

It is argued that a chief obstacle to a naturalistic explanation of the origins of mind is human exceptionalism, as exempli fi ed in the seventeenth century by René Descartes and in the twentieth century by Noam Chomsky. As an antidote to human exceptionalism, we turn to the account of aesthetic judgment in Charles Darwin’s Descent of Man , according to which the mental capacities of humans differ from those of lower animals only in degree, and not in kind. Thoroughgoing (...) naturalistic explanation of these capacities is made easier by shifting away from the substance-metaphysical implications of the search for an account of mind , toward a dispositional account of the origins of mindfulness . According to theists, God is an immaterial thinking being. The main question of this article is whether theism supports the view that we are immaterial thinking beings too. I shall argue in the negative. Along the way, I will also explore some implications in the philosophy of mind following from the observation that, on theism, God’s mentality is in a certain respect magical.

Andrew Steane reconfigures the public understanding of science, by drawing on a deep knowledge of physics and by bringing in mainstream philosophy of science. Science is a beautiful, multi-lingual network of ideas; it is not a ladder in which ideas at one level make those at another level redundant. In view of this, we can judge that the natural world is not so much a machine as a meeting-place. In particular, people can only be correctly understood by meeting with (...) them at the level of their entire personhood, in a reciprocal, respectful engagement as one person to another. Steane shows that Darwinian evolution does not overturn this but rather is the process whereby such truths came to be discovered and expressed in the world. From here the argument moves towards other aspects of human life. Our sense of value requires from us a response which is not altogether the same as following logical argument. This points us towards what religion in its good forms can express. A reply to a major argument of David Hume, and a related one of Richard Dawkins, is given. The book finishes with some brief chapters setting religion in the context of all human capacities, and showing, in fresh language, what theistic religious response is, or can be, in the modern world. Critical care society guidelines recommend that ethics committees mediate intractable conflict over potentially inappropriate treatment, including Do Not Resuscitate status. There are, however, limited data on cases and circumstances in which ethics consultants recommend not offering cardiopulmonary resuscitation despite patient or surrogate requests and whether physicians follow these recommendations. This was a retrospective cohort of all adult patients at a large academic medical center for whom an ethics consult was requested for disagreement over DNR status. Patient demographic predictors of ethics (...) consult outcomes were analyzed. In 42 of the 116 cases, the patient or surrogate agreed to the clinician recommended DNR order following ethics consultation. In 72 of 74 of the remaining cases, ethics consultants recommended not offering CPR. Physicians went on to write a DNR order without patient/surrogate consent in 57 of those cases. There were no significant differences in age, race/ethnicity, country of origin, or functional status between patients where a DNR order was and was not placed without consent. Physicians were more likely to place a DNR order for patients believed to be imminently dying. The median time from DNR order to death was 4 days with a 90-day mortality of 88.2%. In this single-center cohort study, there was no evidence that patient demographic factors affected ethics consultants’ recommendation to withhold CPR despite patient/surrogate requests. Physicians were most likely to place a DNR order without consent for imminently dying patients. (shrink)

Despite increased calls for hospital ethics committees to serve as default decision-makers about life-sustaining treatment for unrepresented patients who lack decision-making capacity or a surrogate decision-maker and whose wishes regarding medical care are not known, little is known about how committees currently function in these cases. This was a retrospective cohort study of all ethics committee consultations involving decision-making about LST for unrepresented patients at a large academic hospital from 2007 to 2013. There were 310 ethics committee consultations, twenty-five of (...) which involved unrepresented patients. In thirteen cases, the ethics consultants evaluated a possible substitute decision-maker identified by social workers and/or case managers. In the remaining cases, the ethics consultants worked with the medical team to contact previous healthcare professionals to provide substituted judgement, found prior advance care planning documents, or identified the patient’s best interest as the decision-making standard. In the majority of cases, the final decision was to limit or withdraw LST or to change code status to Do Not Resuscitate/Do Not Intubate. Substitute decision-makers who had been evaluated through the ethics consultation process and who made the final decision alone were more likely to continue LST than cases in which physicians made the final decision. In our centre, the primary role of ethics consultants in decision-making for unrepresented patients is to identify appropriate decision-making standards. In the absence of other data suggesting that ethics committees, as currently constituted, are ready to serve as substitute decision-makers for unrepresented patients, caution is necessary before designating these committees as default decision-makers. The animalist says we are animals. This thesis is commonly understood as the universal generalization that all human persons are human animals. This article proposes an alternative: the thesis is a generic that admits of exceptions. We defend the resulting view, which we call ‘generic animalism’, and show its aptitude for diagnosing the limits of eight case-based objections to animalism.

This relationship Whitehead calls “mutual immanence.”.

The lung allocation score system in the United States and several European countries gives more weight to risk of death without transplantation than to survival following transplantation. As a result, centers transplant sicker patients, leading to increased length of initial hospitalization. The care of patients who have accumulated functional deficits or additional organ dysfunction during their prolonged stay can be ethically complex. Disagreement occurs between the transplant team, patients and families, and non-transplant health care professionals over the burdens of ongoing (...) intensive intervention. These cases highlight important ethical issues in organ transplantation, including the nature and requirements of transplant informed consent, the limits of physician prognostication, patient autonomy and decision-making capacity following transplant, obligations to organ donors and to other potential recipients, and the impact of program metrics on individualized recipient care. We outline general ethical principles for the care of lung transplant recipients with prolonged hospitalization and give regulatory, research, and patient-centered recommendations for these cases. This paper focuses on the most common state policy responses to the opioid crisis, dividing them into six broad categories. Within each category we highlight the rationale behind the group of policies within it, discuss the details and support for individual policies, and explore the research base behind them. The objective is to better understand the most prevalent state responses to the opioid crisis.

This article addresses the way in which therapeutic practice in an English prison creates conditions whereby both prisoners and prison officers are caught up in networks and relationships of power that contribute to the constitution of particular subjects. The development of therapeutic practice, in relation to prisons and probation, is described and contextualised. Subsequently, the practices of group therapy in operation at Grendon prison - a rather unique institution built on principles of therapeutic community – are analysed with a focus (...) on five ”practices of moulding,” namely, naming, confession, assessment and surveillance, tolerance and participation. The argument that psychotherapy, under conditions of imprisonment, is a form of repression or social control is discussed and dismissed as too simple a model to account for the relations of power and constitutive practices that effect all participants, not only prisoners. Members of staff, as well as prisoners, are shown to be caught up in the disciplinary web. Discipline, as opposed to control, is advocated as a more appropriate concept for understanding therapeutic practices in prison. The work of Thomas Mathiesen, on the concept of synoptic power, is introduced to help illustrate these dynamics. The article represents a shift in my own thinking, from scepticism to a pragmatic idealist position, that creates space for institutions like Grendon to be imagined as potential least worst options for people convicted of offences and obliged to serve “time”. It is my hope, argued for in the article, that Grendon can be conceived of as a “visionary space” with emancipatory potential. (shrink)

Drawing on the genealogical tradition developed by Friedrich Nietzsche and Michel Foucault,Democracy and Domination argues that from the time of Ancient Greece to the present, the collective and centralizing aspects of power have been expanding in the Western world. Modern democracy should be seen as a system of domination that assists in the coordination and expansion of collective power.

The principles whereby the reason operates in ethically complicated situations has been subject to long-standing debates in Catholic Philosophy. A classic text which exemplifies this is Aquinas’s consideration of self-defensive killing. In this paper I clarify two central issues in double-effect reasoning debates surrounding this text. Both issues are connected to the seemingly simple but actually complex task of accounting for the “chosen means” of self-defense. The first issue is whether the “chosen means” are also able to be considered a (...) “proximate end,” to which the intention is directed. The second is determining whether the assailant’s death is related to the “chosen means” per se and therefore to the rest of the moral action. Resolving these issues will provide grounds for answering the broader question implicit in the situation of self-defensive killing: what is to be done when human actions would inevitably entail that some evil is instrumentally tied to realizing some good? Materialists about human persons think that we are material through and through—wholly material beings. Those who endorse materialism more widely think that everything is material through and through. But what is it to be wholly material? In this article, I answer that question. I identify and defend a definition or analysis of ‘wholly material’.

Most behavioral decision research takes place in carefully controlled laboratory settings, and examination of relationships between performance and specific real-world decision outcomes is rare. One prior study shows that people who perform better on hypothetical decision tasks, assessed using the Adult Decision-Making Competence (A-DMC) measure, also tend to experience better real-world decision outcomes, as reported on the Decision Outcomes Inventory (DOI). The DOI score reflects avoidance of outcomes that could result from poor decisions, ranging from serious (e.g., bankruptcy) to minor (...) (e.g., blisters from sunburn). The present analyses go beyond the initial work, which focused on the overall DOI score, by analyzing the relationships between specific decision outcomes and A-DMC performance. Most outcomes are significantly more likely among people with lower A-DMC scores, even after taking into account two variables expected to produce worse real-world decision outcomes: younger age and lower socio-economic status. We discuss the usefulness of DOI as a measure of successful real-world decision making. (shrink)

Some incompatibilists about free will or moral responsibility and determinism would abandon their incompatibilism were they to learn that determinism is true. But is it reasonable to flip-flop in this way? In this article, we contend that it is and show what follows. The result is both a defense of a particular incompatibilist strategy and a general framework for assessing other cases of flip-flopping.

In this article, I focus on internal dimensions of moral responsibility. I argue that if such dimensions are real -- and it seems they are -- then moral responsibility is compatible with determinism.

Many say that ontological disputes are defective because they are unimportant or without substance. In this paper, we defend ontological disputes from the charge, with a special focus on disputes over the existence of composite objects. Disputes over the existence of composite objects, we argue, have a number of substantive implications across a variety of topics in metaphysics, science, philosophical theology, philosophy of mind, and ethics. The development of ethical guidelines and regulations regarding human subjects research has focused upon protection of vulnerable populations by relying on a limited typology of vulnerabilities. This results in several challenges: First, Institutional Review Boards struggle to interpret and apply the regulations because they are often vague and inconsistent. Second, applying the regulations to subjects who fit within multiple categories of vulnerability can lead to contradictions and the rejection of research that would be permissible if only one category were applicable.
